Il consumatore, in conformità al Decreto Legislativo 22 Maggio 1999 n.185 (Attuazione della direttiva 97/7/CE relativa alla protezione dei consumatori in materia di contratti a distanza) ha diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo entro e non oltre il termine di 10 giorni lavorativi dal ricevimento della merce. Il suddetto decreto definisce consumatore "la persona fisica che agisce per scopi non riferibili all'attività professionale eventualmente svolta". Questo diritto è perciò esercitabile solo da coloro che acquistano come persone fisiche per scopi personali non riconducibili alla propria attività lavorativa. Restano dunque esclusi da questo diritto tutti coloro che acquistano come persone giuridiche per scopi inerenti ad attività commerciali e indicano quindi nell’ordine la partita IVA. Tale diritto non può essere rivendicato neppure per acquisti fatti da rivenditori o da soggetti che a qualsiasi titolo acquistano per la rivendita a terzi.

Il diritto di recesso si esercita con l'invio, entro il termine previsto, di una comunicazione scritta mediante lettera raccomandata con ricevuta di ritorno all'indirizzo del venditore presente su E-Bay. La comunicazione può essere inviata, entro lo stesso termine, anche mediante telegramma o fax (al numero 02-30130259), a condizione che sia confermata mediante lettera raccomandata con ricevuta di ritorno entro le 48 ore successive.

Dopo aver ricevuto tale comunicazione sarà contatto il cliente indicandogli le modalità da seguire per la restituzione. All’interno del pacco dovranno esserci tutti gli accessori dati in dotazione e la documentazione del prodotto originaria, se presente.

Al consumatore sarà rimborsato l’importo da lui pagato per il bene acquistato, decurtato di 2,00 (due,00) EURO per le spese bancarie/commessioni PayPal e di gestione. Sono escluse dal rimborso le spese di spedizione che non sono di competenza del venditore.

L'importo netto sarà rimborsato entro 30 giorni dal ricevimento della merce restituita, via bonifico bancario o tramite conto PayPal.

Il diritto di recesso si applica solamente per i prodotti nuovi, restano pertanto esclusi quelli usati.
