Frau Emme war wegen des unberechtigten Einloesens zweier Pfandbons im Wert von 1,30 ausserordentlich gekundigt worden. Das Arbeitsgericht Berlin und das Landesarbeitsgericht Berlin-Brandenburg wiesen die hiergegen erhobene Kundigungsschutzklage ab. Das Bundesarbeitsgericht indes erachtete die Kundigung durch Urteil vom 10.6.2010 fur unwirksam, weil unverhaltnismassig. Auf der Grundlage der vorangegangenen Diskussion um die Entscheidungen der Vorinstanzen und ausgehend von den nicht immer sachlichen Reaktionen in der Presse und der Politik stiess nunmehr auch die Entscheidung der Revision auf eine beachtliche Ruckmeldung aus der Literatur. Dabei war und ist nicht immer ersichtlich, ob der sachliche Gehalt der Entscheidung des 2. Senats das Ausmass der mitunter pathetisch gefuhrten Debatte rechtfertigt. Daher erscheint die Untersuchung lohnenswert, ob und inwieweit sich das Urteil des BAG in die bisherige Rechtsprechung und die dazu ergangene Kritik der Fachliteratur einfugt. Hierbei liegt ein besonderes Augenmerk darauf, wie uberzeugend sich das BAG mit den einschlagigen Rechtsfragen auseinandersetzt und diese Problematiken arbeitsrechtlich fortentwickelt. UEberdies soll diese Arbeit den Blick auf die tatsachlichen Folgen des Urteils fur Rechtsanwender und Rechtsunterworfene weiten.
