Rientrano quindi in questo caso gli acquisti a distanza fatti tramite telefono, o tramite Internet siano essi consegnati a domicilio oppure ritirati presso la sede dell'azienda o presso un punto di presenza sul territorio.

Il diritto di recesso si applica

alle persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attivita' commerciale.

Sono perciò esclusi dal diritto di recesso, gli acquisti effettuati da rivenditori e da aziende.

In cosa consiste

Il consumatore ha diritto, entro un termine di 10 giorni dal ricevimento della merce, di esercitare il diritto di recesso.
