This is a 10-year-old device that was released in 2014, Apple doesn't support this model anymore, which is why it can't be updated, we assume that the buyer does his research and is fully aware of that before making the purchase.
I'm sorry about the battery getting hot, it's not recommended to use the iPad while on the charger as it'll get hot especially if you're running high-end apps. Sorry for any inconvenience you're more than welcome to return the item for a refund if you're unsatisfied.
