Charity or fundraising listings policy

eBay encourages community members to be active in supporting charitable endeavours. eBay permits sellers to list items on eBay and collect proceeds (in whole or in part) on behalf of a charity as long as the listings comply with applicable laws and regulations.

Under Philippine regulations, fundraising may only be conducted on behalf of recognised charities and all members are required to obtain a licence in order to conduct or participate in any fundraising appeal. Please see the Additional Information section for more detailed information of such regulations.

Additional Information

Corporations and associations intending to perform social work and to function as mutual benefit associations and trusts for charitable uses must secure appropriate licences from the Department of Social Welfare and Development and the Insurance Commission, respectively.

Nonprofit educational institutions and health organisations must obtain permits to operate from the Department of Education and Department of Health, respectively.

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Given that charitable fundraising is a regulated area subject to several laws and regulations in the Philippines, sellers are required to comply with all applicable laws before listing them on eBay.
